1. Acceptance of Terms
By accessing or using the Dukkan website (dukkan.app) or the Dukkan dashboard (dashboard.dukkan.app) (together, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
2. Description of Service
Dukkan provides a platform that allows sellers ("Sellers", "you") to build an online store for their Instagram business, list products, and receive orders. Orders placed on a Seller's store can be sent to the Seller via WhatsApp for fulfillment. Dukkan offers Free, Starter, and Pro plans with different features, as described on our Pricing page.
3. Account Registration & Responsibilities
To use the Service, you must create an account and provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
4. Seller Responsibilities
You are solely responsible for the content of your store, including product listings, descriptions, images, pricing, and any claims you make about your products. You are responsible for complying with all laws and regulations that apply to your business, including those relating to consumer protection, pricing, and taxation.
5. Acceptable Use
You agree not to use the Service to:
- Sell illegal, counterfeit, or prohibited goods
- Engage in fraudulent, deceptive, or misleading practices
- Infringe the intellectual property or other rights of any third party
- Interfere with or disrupt the operation of the Service
We reserve the right to suspend or terminate accounts that violate these Terms.
6. Plans & Fees
Dukkan offers Free, Starter, and Pro plans as described on our Pricing page. Paid plans are billed on a recurring basis (e.g. monthly) until cancelled. Fees are non-refundable except where required by law. We may change our plans and pricing from time to time, with notice to affected Sellers.
7. Third-Party Services Disclaimer
The Service integrates with third-party services, including WhatsApp/Meta, to enable order communication. We do not control and are not responsible for the availability, content, or policies of these third-party services. Your use of WhatsApp or any other third-party service is subject to that service's own terms.
8. Intellectual Property
Dukkan and its licensors own all rights, title, and interest in and to the Service, including its software, design, and branding. Sellers retain all rights to the content they upload to their stores (such as product images and descriptions), and grant Dukkan a limited license to host and display that content as part of operating the Service.
9. Termination
You may stop using the Service and close your account at any time. We may suspend or terminate your account if you violate these Terms or if we discontinue the Service. Upon termination, your store may no longer be accessible, and we may delete your data in accordance with our Privacy Policy.
10. Disclaimers & Limitation of Liability
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. To the maximum extent permitted by law, Dukkan shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of Oman, without regard to its conflict of law principles.
12. Changes to Terms
We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date at the top of this page. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
